Q: What does it cost to file a Bankruptcy?
A: The fees charged by Chapter 13 Clinic or Stariha Law offices, P.C.,
for matters relating to bankruptcy are generally regulated by the Court.
The range charged by Stariha Law Offices, P.C. or Chapter 13 Clinic
begins at $1,100.00 for an individual consumer bankruptcy. Chapter 7 for
Married couples begin at $1,250.00 for Chapter 7 cases. The fee is
generally $2,500.00 for Chapter 13 cases, whether for an individual or for
a married couple. Chapter 11 business reorganization and Chapter 12
farming cases are virtually always done on an hourly basis due to the
inability to predict with any certainty the amount of time that will be
necessary to be expended in any given case. Fees for Chapter 7 and
Chapter 13 will increase with the complexity of the case and the amount
of work anticipated to be involved. In a Chapter 7 fees must be paid
before the filing of the bankruptcy. In a Chapter 13 the fees can be paid
over a period of time as part of the payments made by the debtors to the
Trustee. Generally the fees can be expected to increase substantially
where a business is involved, there are more than 15 creditors or a
pending foreclosure.
In any bankruptcy case there are, in addition to attorney fees, filing fees
associated with the case. The filing fees established by the United States
Bankruptcy Court for Western District of Michigan were as follows:
Chapter 7 - $299.00; Chapter 13 - $274.00; Chapter 12 - $239.00; and
Chapter 11- $1,039.00
